Wal-Mart closes Quebec unionized shop

Wal-Mart Canada Corp. said Thursday its has shut down a second unionized location in Quebec, citing cost increases caused by an “unworkable†new labour contract.
The move drew accusations from the union that Wal-Mart has breached the workers’ constitutional rights to organize.
The shutdown involves five employees at a Tire and Lube Express (TLE) attached to the company’s store in Gatineau. This compares with about 200 who lost their jobs in April, 2005, when Wal-Mart shut down its store in Jonquière shortly before binding arbitration on a labour contract was set to start.
The Gatineau TLE was the giant U.S.-based retailer’s only unionized location in North America. However, arbitration is under way for contracts at several of its other Quebec outlets, including a TLE in Hull, as well as the Wal-Mart main store and TLE in St. Hyacinthe, according to Derek Johnstone, a spokesman for the United Food and Commercial Workers of Canada (UFCW) union, which represents the workers.

Wal-Mart Canada said in a news release that it plans to offer the five workers and the manager of the automotive operation jobs at other TLEs or elsewhere in the Gatineau store, which employs 250 workers.
Workers in the main store are not unionized, Mr. Johnstone said.
He said a collective agreement for the five workers was imposed in August by the Quebec Labour Board.
Wal-Mart Canada said in its news release that the agreement gave the unionized workers a 33 per cent wage increase.
This, it said, would have raised operating costs at the Lube Express by “at least 30 per cent,†and forced the company to raise all its prices by the same amount.
Such a “dramatic†price hike would have been at odds with Wal-Mart Canada’s commitment to “save people money,†company spokesman Andrew Pelletier said.
The TLE outlets operate on “extremely narrow profit margins,†and the UFCW contract would have made the Gatineau branch unprofitable,†he said.
The Bentonville, Ark., retailer has been under fire from labour groups for years for keeping unions out of its U.S. stores.
However, Mr. Pelletier denied that Wal-Mart is anti-union, citing the fact that it had been trying for three years to reach an acceptable contract in Gatineau. “We are disappointed it came to this,†he said, but added that the contract imposed by the Quebec Labour board “is not a reasonable contract by any stretch of the imagination.â€
However, UFCW national president Wayne Hanley said in a news release that the shut-down is “another attack on [Wal-Mart Canada’s] workers, on the community, and one more example of its blatant disregard for Canada’s Charter of Rights and Freedoms.â€
In August of this year, the Supreme Court of Canada agreed to hear appeals by several of the workers who claimed they had been unfairly deprived on their jobs because of their union activities when the company shut down the Jonquière store.

WASHINGTON (AFP) — US sports equipment maker Nike has started legal proceedings against giant retailer Wal-Mart over an alleged copy of its “Shox” sports shoe, court documents showed Friday.
“Without Nike’s authorization, Wal-Mart has offered for sale and sold in the United States shoes having designs that are covered by the Nike design,” Nike said in its suit lodged in a Chicago court.
“Wal-Mart knowingly and intentionally sold and continues to sell the infringing shoes as simulations of Nike shoes.”
Nike is claimed unspecified damages and the withdrawal of the alleged copies of its Shox trainers, which have shock-absorbers visible in the heel of the sole.
Wal-Mart could not be reached for comment.
