Judge Upholds $185 Million Award in Wal-Mart Class Action

A Philadelphia judge has affirmed a $185 million award against retail titan Wal-Mart in a class action alleging underpayment of Wal-Mart employees as part of an opinion written for an appeal now pending with the Pennsylvania Superior Court.

Common Pleas Judge Mark I. Bernstein’s opinion under Pennsylvania Rule of Appellate Procedure 1925(a) said the appeals court should affirm a jury verdict finding over 186,000 current and former Pennsylvania Wal-Mart employees were not properly compensated for off-the-clock work and missed rest breaks between March 19, 1998, and May 1, 2006.

The jury found that Wal-Mart employees were owed $1,462,910.35 in damages for off-the-clock work and $27,715,964 for rest break violations between March 19, 1998, and Dec. 31, 2001, and $1,031,430 for off-the-clock work and $48,258,111 for rest break violations between Jan. 1, 2002, and May 1, 2006, Bernstein wrote in his opinion from Wednesday.

Bernstein also said that the Superior Court should affirm his judgment that Wal-Mart should pay $62.2 million in statutory liquidated damages, $10.2 million in prejudgment interest, $33.8 million in statutory attorney fees and $11.9 million in nonstatutory attorney fees.

The total judgment against Wal-Mart now stands at $187,648,589.11.

Wal-Mart is the epitome of American Imperialism!

  4. Shelie says:

    Is this available in Quebec?

  5. Catherine says:

I called my local wal-mart and they had no idea what this flyer was that I was referring to. I live in Brampton, ON. They do not have this flyer or these specials running at my local store. Where did this flyer come from Radley? I would love to purchase the Philips Divx player for $29.96! Fantastic price!

  6. Catherine says:

I also can not find this flyer listed on their website for any of the stores I check the online flyer for Ontario.

  7. Boo Radley says:

This flyer starts on SEPT 19, 2008

    Taken from WMW
Forbes’ list of the top 400 richest Americans and now comfortably reside in slots four through seven on the list of top ten wealthiest people in the country. Sam Walton’s four children aren’t the only Walton family members on the list: E Stanley Kroenke and his wife Ann Walton Kroenke also make an appearance, as does Sam’s niece, Nancy Walton Laurie. Taken together, the family is worth over $100 billion.

Wal-Mart executives have refused to raise wages for the company’s lowest earning employees, stating that such increases would cut in to company profits. Obviously, profitability is not a problem. As Wal-Mart sees record sales and the Walton family climbs to the top of America’s economic ladder, the company should be ashamed

Whats the starting rate at walmart these days?
I know when I was laid off 4 years ago I filled in there for 2 months helping put in the grocery aisle (couldnt sit and home and just collect pogey I was so bored) and made 10 to start, and minimum wage was a lot lower then…. But I do remember some Wally employees really mad because I made more then them and they had been there 5 years.

Aside from that thanks for posting Sir Radley, don’t see much for us unfortunately.

A lady I know said that her adult daughter is making $9 something an hour after 3 years. This is full time. Also she mentioned that her daughter had people answering to her that were making more (possibly because they have been there for a much longer period).
    Hope this helps.

  17. Candy says:

I work at Wal Mart, actually I’ve worked at three different stores, my start was $10, I’ve been there 4yrs now and make $11.75. Far more then I made temping and the start was $0.25 less then my start was at an auto parts plant 6 years ago oh and BTW their start pay hasn’t increased either, my dad still works there and it’s the only wage that hasn’t increased. (I worked at three different stores because we kept posting out, one of the only jobs I know of that if you leave the area will help you get into one of their other stores if you wish. So much better then going back out and having to job hunt again!)

If people don’t like the wages, don’t work there, I know plenty of people who make far less doing far more then any employee there.

  18. Maddie2008 says:

Why is this even on the blog. The date on the bottom of the flyer pictured says October 2008, and the postings say Sept 2008.
    Whats the deal here??
    I am confused
