I’m sorry for posting another request for help but this person seems very determined to take action unless I delete a post about a customer’s experience! I can simply go ahead and delete the post but I feel like this is censorship! So can you guys please let me know what to do about this so that I do not get into legal trouble.
As you know The Canadian Reviews Blog allows people to submit either their good or bad customer experience. I post the reviews as: uncensored and unmodified. People are then free to comment about the store, service, agree with it, disagree, add to it or whatever. It is a completely neutral unbiased service.

I was notified by one of my clients (who happens to be a lawyer) that she had found this article on your website. A. D’Sousa is a past client who obviously was not happy about the service she received due to faults of her own which she has not admitted. She states the following “They know exactly how to screw up your wedding experience by almost not having a dress. They have no professionalism, no courtesy calls if they miss an appointment & to top it all of they try & blame you for something or the other.” Ms. D’Sousa was given her dress in July of 2009 and at least 3 months before her wedding. Her accusations are false and I will be filing a libel suit in court.
The term libel is as follows:
“Libel involves the making of defamatory statements in a printed or fixed medium, such as a magazine or newspaper.
Typically, the elements of a cause of action for defamation include:
- A false and defamatory statement concerning another;
- The unprivileged publication of the statement to a third party (that is, somebody other than the person defamed by the statement);
- If the defamatory matter is of public concern, fault amounting at least to negligence on the part of the publisher;
- and Damage to the plaintiff.”
Please advise whether or not the article will be removed. I would appreciate your attention to this matter and I thank you in advance for your assistance.

Stephen Harper sang the Beatles Song “With a Little Help from My Friends” with Yo Yo Ma at a surprise visit to the National Arts Centre and his performance was spectacular! Now we know Harper will have a thriving career even after he’s no longer a prime minister, but it’ll be as an artist 😛
I’m very proud of our Prime Minister! It’s good to see him take the time to do something fun and light hearted and show what a great nation we are.

I had really gotten bored of Internet Videos recently as they seemed to lack any creativity what-so-ever… but this video, shot in one take by Université du Québec students, is pure awesomeness. This Black Eyed Peas song on the other hand… well, I’ll let you decide on that.

So last week with the ” Luck ‘o the irish” my youngest child wanted to purchase some Lucky Charms! As a treat I agreed.
A day later I poured my child and I a bowl. As I was picking out the marshmallows (because lets be serious I only eat the marshmallows.) I realized how small they were! Sure it had been years since I had indulged in this sugary cereal but I don’t remember them being so micro mini. I checked out the box and sure enough they have downsized the marshmallow to get “more in each spoonfull.” Bull I say there is less period.
I’ve since then I realized I wasn’t becoming a “Canadian giant” I was just being duped into not realizing packagaing and contents are getting smaller.
For example have you ever grabbed a box of crackers that claim ” 33% less fat” then you get home and realize the package you just bought is 33% lighter then the same brand with the fat?
Or somethings on sale really cheap but 200g smaller in size then the regular priced item of the same brand. When you sit and figure it out by gram your saving 10 cents. Grrr….
YIKES!

I’m very proud to say this! I’m proud that the SmartCanucks Community, which might not be familiar to many blog readers, has some of the most wonderful, caring and compassionate people ever 😀
Did you know that many SmartCanucks members collect coupons, use them to buy products and donated to shelters around Thanksgiving, Christmas and other times of the year? We have had this as an ongoing activity on SmartCanucks and it puts a smile on my face every time I read about these little special acts of kindness 🙂
I’ll share with you some of the many beautiful contributions over the next few months starting with the most recent:
As many of you know, I have been collecting stuff using coupons to make up shelter packs for the local women’s shelter in time for Thanksgiving.
Well, today, I finally finished them, as I picked up the last of the products I needed at Wal-mart’s Anniversary sale. I made 12 in all and I couldn’t have done this alone, as I’ve got a little help from my SC’r friends who have donated coupons towards my shelter stash. Thanks all
I called the shelter to let them know I will be deliverying them tomorrow and they were pleased to hear of my donation.
So, without further adieu, here is what is in them, what they look like and the rest of the details…

A sample of the bags – these have two handles, a drawstring and are cloth mesh, so perfect to put damp toiletries in and hang up to dry out. What’s even better, they were only $1.00 ea. at the dollar store!

Feels good to be done, will feel better to deliver. I figure I probably spent about $10 a bag, but they are probably worth at least $40 each, so I am happy that I could contribute almost $500 worth of products to a worthwhile and deserving cause.

So I’m flipping through the October issue of Canadian Living looking for coupons (scan for coupons first, read later) when I see the word ‘coupons’. Upon closer examination I discover that it is an article entitled “Online Coupons” by Deena Waisberg. Hmm, I wonder to myself, what sites does she list? I scan the bolded text box on the bottom right hand side of the page, pretty much assuming it’d be save.ca and the like, and what do I see but – you know what’s coming here don’tcha??? http:smartcanucks.ca !!!!!!!!! Woohoo! That’s Us!! I mean I know it’s Boo Radley (did I mention you’re fantastic!) but collectively it’s us!!!! Right there in print on page 186 of Canadian Living – wooh Boo your name’s going to be in bright lights! (well, your user name anyway ;-p) Congrats SmartCanucks!!

Thanks for all the invaluable ideas and suggestions! I appreciate all your help. Sorry I couldn’t respond to individual comments but I did take the time to read each and every one.
First of all, as most of you suggested I removed the blog post in question and deleted the image and pdf file.
Regarding the idea of boycotting Walmart, I really don’t think it will make any difference. Walmart is huge and to them we’re like a needle in a haystack. If we completely stop talking about them we’d also be doing exactly what they wanted to do, shutting us up. I think I will be talking about Walmart more! I’ll post Walmart deals and reviews on here whether they are good or bad and will show them that they can’t shut me up. I will also start a new subsection dedicated to people freely talking about Walmart.
If you want to help out, please write an email to Amy Wyatt, PR and Brand Reputation Manager at Wal-Mart Stores, Inc. telling her about how we were accused of fraud and phishing when all we were doing was helping out Walmart and giving them free advertising!
As for the letter to the lawyer, I used the suggestions from your comments and wrote the following. I’ll email it to Scott tonight once I get your feedback on it.

Smart Canucks deeply apologizes for the misunderstanding that has occurred. Smart Canucks is simply a website where users inform each other of great shopping deals around Canada. Since users are able to upload images Smart Canucks has never, and will not claim responsibility for images. We do however do our best to ensure everything on our website is completely 100% legal and we try our best to remove any images on the website that are trademarked to Walmart.
To comply with your demand the blog post in question has been removed and all members informed of the misfortune. That deal was however a legitimate Walmart / P&G promo that was held in January of 2009.
Furthermore for your future knowledge, know that Smart Canucks does NOT carry out any kind of phishing or credit fraud and does NOT collect personal information for misleading purposes and fraud.
Please also note that Walmart Canada’s marketing has contacted us about the possibility of advertising on SmartCanucks.ca because they have realized the free advertising that Walmart gets through SmartCanucks.ca.

I really don’t understand what’s wrong with Walmart! They send me an email making complemetly false claims and almost threating me to comply to their requests.

Regarding their claims:
“…. Walmart has not approved the content of the Web Site, which has already given some consumers the patently false impression that it is approved by or somehow affiliated with Walmart.”
Note that the blog post they are referring to was posted on January 5th, 2009 and I clearly state that “Offer is valid on purchases dated January 1 to January 31, 2009.” Furthermore, it was a 100% legitiamte Walmart / P&G offer back then and the rebate form was located on Walmart’s website at http://walmart.ca/wps-portal/storelocator/pdf/pampers1.pdf (they’ve removed it now).
“Walmart is also extremely concerned that consumers’ personal information is being collected in this misleading ways for purposes of illicit phishing and credit fraud activities.”
I find this sentence very offensive since I do not even have a form where people can submit their personal information. All I have is a comments section and this is for people to discuss the offers.
What’s more ironic is that Walmart Canada’s marketing department contacted me a couple of months ago about advertising on SmartCanucks.ca.
Anyone with legal experience know what I can do? Walmart’s claims are false, they are bullying me and they are trying to confine my freedom of speech! Please help, I don’t want to get sued by Walmart!
